Terms
and Conditions
Tour Structure & Itineraries:
CMT tours are structured to the degree that we all begin and end each day at
the same point. In between, you can be as structured or unstructured as you
want to be. To the extent they want, riders can travel at their own pace, take
side trips, and stop along the way on their schedule, not ours.
We encourage individual exploration and we
want our clients to have time for peaceful reflection as we experience the
scenic wonders of the American West. Our goal is to make your holiday/vacation
trouble-free and totally satisfying.
CMT reserves the right to cancel or change
any tour in accordance with operating requirements or circumstances. If
unforeseen circumstances beyond our control make changes necessary, we reserve
the right to alter itineraries, travel routes, hotels, and restaurants as
required. Should cancellation or change be necessary, CMT will offer you the
choice of an alternative tour date or a full refund. CMT is not responsible for
any other travel arrangements affected by our cancellation or changes.
Hotels:
Accommodations are provided each night in a deluxe hotel, lodge, or bed and
breakfast. Most have swimming pools and/or spas. Tour pricing is based on
double occupancy. Solo riders who don't want to share a room should add the
single room supplement to the tour price.
Meals:
For the Day-Tripper tours, you are on your own for breakfast and dinner since
we begin and end each day in San Diego.
For these tours, lunch is included. For all of the multi-day tours, breakfast,
lunch, and dinner are included.
Bikes, Cars !?
Although our tours are promoted as "motorcycle tours", we recognize
that not everyone rides. If you have friends that don't ride motorcycles, they
may still join any of our tours and travel by car. An automobile may be rented
(how about a sporty convertible?) at very reasonable rates for the entire tour.
Please contact us if you are interested in this option.
Motorcycles are provided for each tour and
are included in the tour price. All of our bikes are late-model Harley Davidson
and each is equipped with a passenger backrest, saddlebags and most models have
a windscreen. The different models are available on a first-come basis, so
reserve early. CMT reserves the right to change or substitute motorcycle models
in accordance with operating requirements or circumstances.
Tour Reservations:
You can make your tour reservation right here, by going to the Reservation
page, completing the required information, and clicking the "Submit"
button. (Alternatively, you can print the completed Reservation page, then fax
it to CMT or mail it along with a check for the deposit.)
Payment Policy:
A deposit of $500 per person is required to reserve space on a tour. Payment
must be received within 10 days of receipt of your reservation form. The
balance is due no later than 30 days prior to the tour. CMT has the right to
cancel your reservation and apply cancellation charges as indicated below if
payments are not received as specified.
Cancellation and Refund Policy:
- An administrative fee of $50 will be assessed for cancellations made more
than 45 days prior to the tour.
- The full deposit amount may be assessed for cancellations made less that 45 days prior to the tour.
- There will be no refunds for unused services or accommodations once the tour
has started.
- If you believe your trip is at risk for any reason, we recommend that
you purchase trip cancellation insurance.
Safety:
California
law requires that a safety helmet be worn while operating or riding on a motorcycle.
The states of Arizona and Utah
(Desert Tour) and
Idaho and Montana (Northwest Adventure Tour) do not
have compulsory helmet laws. CMT strongly recommends that a helmet be worn for
comfort and safety at all times while riding on our motorcycles.
CMT prohibits tour participants from
consuming alcohol or taking illegal drugs during any ride day. Having a drink
or two at the end of the ride day is fine but we encourage riders to not "over
indulge". Anyone found to have consumed alcohol or illegal drugs prior to or
during any day's ride may be prohibited from riding for the remainder of the
tour. CMT reserves the right to decline, accept or retain any tour participant
at any time.
Weather:
The weather in California
and the American West is generally mild with temperatures between 60F [15C] and
95F [35C]. Mountain temperatures are cooler and may dip into the 40's [5-10Cin
the early morning hours. The Desert Tours operate during
the spring and fall to avoid the peak summer heat. Similarly, the Northwest Adventure,
Beach & Mountain and Peaks & Passes tour dates have been selected to
correspond with the best riding weather. We occasionally encounter rain, so CMT
recommends you bring a rainsuit. Prior to the tour date, CMT will provide you
with a comprehensive list of things to bring (and not bring) to make your tour
experience as comfortable as possible.
Under no circumstances shall CMT be held
responsible for rain, wind, snow or other weather conditions, nor can your tour
participation be cancelled or amended by you on the basis of rain, wind, snow
or other weather conditions.
Equipment Problems:
- Our bikes are well-maintained late-model Harley-Davidsons. Mechanical
breakdowns are rare. If a motorcycle becomes inoperable due to mechanical
failure and the problem cannot be reasonably resolved, a replacement motorcycle
will be provided.
- If a motorcycle becomes inoperable for any reason other than mechanical
failure, it will not be replaced.
- CMT provides a high quality lock for each motorcycle that shouldt be used at
all times when the motorcycle is unattended. A stolen motorcycle will not be
replaced.
- CMT will not be liable for missed reservations or other expenses incurred as
a result of any motorcycle breakdown or loss.
Insurance:
CMT provides bodily injury and property damage liability insurance as required
by law. However, this doesn't cover possible damage to (or theft of) the
motorcycle. Purchase of comprehensive and collision insurance is optional but
highly recommended. Without this insurance, the rider will be responsible for
the full cost of damages to (or loss of) the motorcycle plus all damage to
others in the event of an accident. If you think your own insurance will cover
the rental bike, I recommend you verify this in advance and bring proof of
insurance with you.
For
tours starting in San Diego,
if you choose to purchase insurance, for a bundled price of $27.95 per day:
- Loss Damage Waiver (LDW) covers damage to or loss of the motorcycle with zero
(0) deductible.
- Supplemental Liability Insurance (SLI) provides up to $1 million for bodily
injury and property damage to others.
- Personal Accident Coverage (PAC) provides medical coverage up to $2,500 each
for rider and passenger and a death benefit of $50,000 for the rider and $25,000
for the passenger.
- Personal Property Coverage (PPC) covers damage to personal property (helmet,
jacket, etc.) up to $750.
Note
that you can select some of the above coverage at a reduced price. You select
the insurance when you pick up the bike.
A
security deposit will be authorized on your credit card at pickup and refunded
when the motorcycle is returned. With the optional insurance, the deposit
authorization is $1,000; without insurance, it's $2,000.
For
tours starting in Seattle (Northwest Adventure), insurance is available as
follows:
- Loss Damage Waiver (LDW) covers damage to or loss of the motorcycle. If the
bike is damaged, the deductible is $2,000. If the bike is stolen or totaled,
the deductible is $5,000. Cost for the LDW is $26.65 per day.
- Supplemental Liability Insurance (SLI) provides up to $1 million for bodily
injury and property damage to others. The cost for SLI is $13.65 per day.
- Personal Accident & Property Insurance (PAP) provides medical coverage up
to $2,500 each for rider and passenger and a death benefit of $50,000 for the
rider and $25,000 for the passenger. In addition, it provides personal property
(helmet, jacket, etc.) coverage up to $750 each.
You
select the insurance when you pick up the bike.

Responsibilities:
It is the responsibility of CMT to properly arrange and conduct your tour per
the tour descriptions contained herein. However, CMT and its owners and agents
shall not be responsible for, and shall not accept liability for any claims,
damages, losses, costs or expenses arising from: (a) Personal injury, disease,
sickness, or death, however caused, while engaged on or by reason of your
participation on any CMT tour whether due to maintenance, use, operation or
control of any motorcycle, automobile, hotel, airline or other common carrier
used in conjunction with the tour. (b) Loss or damage to luggage or other
property. We recommend you purchase travel insurance covering loss, damage or
theft of luggage and personal belongings. (c) Delay, failure or loss resulting
during a CMT tour due to the actions of hotel operators, airlines and other
common carriers, other suppliers, or due to government action, mechanical
breakdown, weather, labor disputes, terrorism, acts of war, acts of God, or any
other causes beyond CMT's direct control.
Waiver & Release Agreement:
EACH TOUR PARTICIPANT MUST AGREE TO AND SIGN THE FOLLOWING WAIVER &
RELEASE:
My payment of a deposit constitutes my understanding and acceptance of the
information, terms and conditions contained herein. I further understand and
accept that the California Motorcycle Tours (CMT) tour and related activities
involve risk of personal injury or death and damage to, or loss of property. In
consideration of the benefits to be derived, I hereby accept all risks of
personal injury and property damage arising from my participation in this CMT
tour and I hereby agree that I, my dependents, heirs, executors and assigns do
release and hold harmless CMT and its owners, employees and agents from any and
all claims, including claims of death, bodily injury, illness, property damage
or loss, however caused, arising from or related to this CMT tour.
Further, by payment of a deposit and/or my
signature on this form, I certify that I do not have any physical condition,
mental condition or other disability that would create a hazard for me or other
tour participants. I believe I possess the necessary riding experience and
ability to competently handle a heavy weight motorcycle. I also certify that I
am over 21 years of age and that I am in possession of a currently valid
motorcycle operator's license.
I have carefully read the tour descriptions,
Terms and Conditions and this Waiver & Release Agreement, and will abide by
everything as stated herein or elsewhere published by CMT. Further, I affirm
that I have not received or relied on any oral or written representation of CMT
as a basis for executing this Waiver and Release.
